CONDITIONS OF USE OF THE SITE AND SALE OF SERVICES


1. Owner involved in the operation of the Site and performance of the Services

1.1. The services contained on this website are offered by the entity Norwegian With Tor ("Norwegian With Tor"). These Terms set out the terms and conditions under which you may use our website and the services we offer. By accessing or using the website for our service, you agree that you have read, understood and agree to be bound by these Terms.

1.2. Norwegian with Tor operates as its own event organizer, in compliance with all applicable laws and regulations. For the sake of clarity only, Norwegian with Tor does not operate as a travel agency.

2. Customer’s commitments

2.1. The customer registered on the Site (“you”) warrants the truthfulness and accuracy of the information provided by him/her on his/her behalf, and on behalf of and for all beneficiaries of the Services (as defined below) purchased on the Site, and for whom he/she assumes the capacity of representative. These Terms and Conditions shall apply to all beneficiaries of the Services.

2.2. No liability can be attributable in any way to Norwegian with Tor if the information provided by you, including as a representative of other beneficiaries, when registering and/or ordering (name, mailing address, e-mail, telephone, etc.) is false or incorrect. It is specified that the names and surnames of the participants of the event, entered by you at the time of registration and appearing in your personal area [personal details], are automatically reflected in the fields relating to the identity of the participants during the booking process: it is your responsibility to verify for each order that the information relating to the participants is correct and, if necessary, to change it.

2.3. Norwegian with Tor reserves the right to reject any booking requests from you at any time if fraudulent or malicious use of the Site results.

3. Conditions of use

3.1. These Terms and Conditions govern your use of the Site and the sale of the services offered in Norwegian with Tor’s online catalogues available on the Site (the “Services”).

3.2. The Terms and Conditions constitute a binding agreement between Norwegian with Tor and you. You are also subject to the special conditions applicable to individual Services that are specified in Norwegian with Tor’s online catalogues. These special conditions form an integral and substantial part of the contract between Norwegian with Tor and you. Use of the Site, bookings and purchase of the Services are also subject to your acceptance of these special conditions.

3.3. You are therefore required to read and expressly accept in full these Terms and Conditions as well as any special conditions applicable to the individual Services by confirming your purchase. In the absence of acceptance of these Terms and Conditions and any special conditions applicable to the individual Services, it will not be technically possible to proceed with the confirmation of the reservation and the purchase of the Services.

3.4. The Terms and Conditions may be changed by Norwegian with Tor at any time, without prior notice, it being understood that such changes will not apply to orders placed by you prior to the change.

3.5. Norwegian with Tor reserves, at its discretion and at any time, the right to terminate the contract with you in case of improper use of the Site or contrary to the accepted terms and conditions.

4. Duration of offer

Offers of Services are normally valid for as long as they are on the Site, until all available seats are filled, unless otherwise specified in the offer itself and may change in real time. Photos in the descriptions are for illustrative purposes only and are not binding.

5. Prices and Fees

5.1. The descriptions of Services in our online catalogues specify for each type of event and Service the services included in the price and any special conditions applied to those Services. Prices quoted are those in effect at the time of booking.

5.2. All our prices are quoted in Euros and include VAT. 

5.3. Our prices are contractual rates and no dispute can, therefore, be raised regarding the price of the Services after a reservation has been made. For Services that include accommodation, prices are calculated based on the number of nights and not the number of full days.

5.4. Unless otherwise stated in the offer, prices do not include:

  • the tourist tax;
  • the late check-out and early check-in surcharge;
  • meals not included in the formula of the chosen accommodation;
  • drinks consumed not included in the formula of the chosen accommodation;
  • travel and transportation expenses (it is understood that it is the participants’ responsibility to obtain any documentation and requirements for entry into the country where the event will be held);
  • paid activities;
  • personal expenses

and, in general, anything not specifically mentioned under “The price includes”.

6. Extraordinary price changes

Subject to notification to you, Norwegian with Tor reserves the right to increase the price of the package according to any changes involving exchange rate differences, when a part of the Services is billed by the supplier to Norwegian with Tor in foreign currency.

7. Reservation and acceptance of the offer

In case of booking via Internet, the Terms and Conditions will be proposed to you during the purchase procedure. By confirming your purchase, you declare that you have read and accept these Terms and Conditions. Acceptance of the Terms and Conditions has the value of recognition and acceptance of the set of conditions illustrated in this document by you, also on behalf of the other participating parties who will therefore also be bound by these Terms and Conditions. 

8. Availability of offers

All of our online offers are normally available. Should the provider inform us that the offer that is the subject of the reservation is no longer available, you will have the option to take advantage of another package of equivalent quality at no extra charge, or to be refunded, within 14 (fourteen) business days from the time of withdrawal or cancellation, of the amount of money already paid.

9. Payment and billing

9.1. Payment can be made by credit card or rechargeable prepaid card belonging to the circuits indicated on the payment page at the end of the booking process.

9.2. Upon completion of the purchase and payment of the deposit, a reservation request confirmation will be sent to you. By the end of the 30th day preceding the start date of the event, Norwegian with Tor will send to you the details for the payment of the balance of the price. You may proceed to prepay the balance at any time by contacting Norwegian with Tor via email at [email protected] or on the “Contact Us” page of the Site. In the event that, after the completion of the order, an error is detected in the payment method, Norwegian with Tor cannot be held responsible for it under any circumstances and will not be obliged to refund all or part of the amount paid. 

9.3. Finally, you warrant that you are fully empowered to use the credit card or prepaid card you are using for the purchase. The invoice is issued as soon as possible (normally within 48 hours) after payment of the balance and it is sent electronically to you. The invoice is in the name of the individual who made the reservation and the name on the invoice cannot be changed post-sale. The amount on the invoice indicates the total amount of the package, which cannot be fragmented or in the name of more than one person under any circumstances. 

10. Right of withdrawal

With regard to the right to withdraw from this contract, the provisions of the applicable law shall apply.

11. Accommodation and stay

11.1. Hotel Category

11.1.1. The number of stars given to a hotel indicated in the description corresponds to a classification established according to the local regulations of the country where the service is provided and may therefore differ from those in Italy or Europe. We try to be as accurate as possible in informing you about the conditions of the accommodation. The ratings given in the description are the result of our knowledge of the facilities and the opinions of Norwegian with Tor and are given purely as an indication without constituting any express or tacit guarantee. We reserve the right to substitute for technical reasons, in case of force majeure or for facts attributable to third parties, the planned hotel with a facility of the same category offering substantially equivalent services. These are exceptional cases of which you will be notified as soon as Norwegian with Tor becomes aware of them.

11.1.2. Norwegian with Tor is not responsible vis-Ă -vis you and/or the hotel for any breach by you of the hotel conditions and regulation.

12. Meals

Meals at the hotel depend on the formula provided in the offer.

All inclusive: includes overnight stay, breakfast, lunch, dinner and beverages during meals (by way of example, mineral water, juices, soft drinks, wines, local liquors) generally from 10 a.m. to 10 p.m. Some alcoholic beverages may not be included in this formula, so they will be billed directly by the hotel. 

Full board: includes overnight stay, breakfast, lunch and dinner, excluding drinks.

Half board: includes overnight stay, breakfast, lunch or dinner, excluding drinks.In full or half board, beverages are excluded unless exceptions are duly noted in the description. All additional drinks not included in the formula must be paid directly on site to the hotel. On site, the hotel regulations must be respected by you, especially regarding the opening hours of restaurants, bars, and places used for the consumption of meals.

13. Activities proposed during the event

13.1. Some activities proposed during the event may involve risks. Norwegian with Tor is in no way responsible for accidents or injuries attributable to you or to the acts of third parties, or to fortuitous or force majeure events. Excursions, services and benefits purchased by the participant on site and not included in the purchased package are unrelated to the contract entered into by Norwegian with Tor. Therefore, no liability can be attributed to Norwegian with Tor, either as organizer or service intermediary even in the event that, as a courtesy, local residents, chaperones or correspondents may take care of the booking of such excursions.

13.2. Norwegian with Tor will not be responsible if such activities are cancelled due to weather, cases of force majeure, or if the minimum number of participants required to carry out the activity is not reached. This will not result in any refund.

14. Pregnant Women

Regarding event bookings, we advise pregnant women to consult their doctor before making a reservation in order to confirm the suitability of the event for the woman, any liability in this regard on the part of Norwegian with Tor being excluded.

15. Liability and Warranty

15.1. For services

15.1.1. Our suppliers and partners who will participate in events are chosen with special care. Norwegian with Tor will not be liable in any way for failure or improper performance of any of the elements of the package attributable to you, suppliers, partners, a force majeure event, a fortuitous event, or a third party unrelated to the provision of Services under the contract. However, Norwegian with Tor’s liability is excluded for all services purchased from third parties.

15.1.2. Without prejudice to the provisions of these Terms and Conditions, compensation for damages suffered by you and attributable to Norwegian with Tor shall be governed by applicable laws.

 

16. Modification and cancellation of reservation

16.1. Modification Procedures

16.1.1. Should you wish to make any changes to your confirmed reservation you must notify Norwegian with Tor in writing within 20 (twenty) days prior to the start date of the event. Norwegian with Tor may answer within 48 hours after the request. In any case, Norwegian with Tor cannot guarantee to meet the requests of changes. Norwegian with Tor’s failure to answer shall be interpreted as a denial to make the requested changes.

16.1.2. Change requests are applicable only for correction of the name of the beneficiaries of the order.

16.1.3. Any changes can be requested by you directly via email at [email protected] or on the “Contact Us” page of the Site.

16.2. Cancellation Procedures

16.2.1. Should you wish to cancel your confirmed reservation, you must notify Norwegian with Tor within 15 (fifteen) days prior to the start date of the event. In this case, Norwegian with Tor will have the right to retain the amount of the deposit and/or the balance of the price already paid by you.

16.2.2. Any request to cancel an order must be made by you directly via email at [email protected] or on the “Contact Us” page of the Site.

16.2.3 In case you intend to cancel the reservation after the term above, you shall pay a penalty to Norwegian with Tor. The amount of such penalty shall be immediately communicated to you to validate the cancellation.

16.2.4. Some commercial offers, regardless of the type of product and by virtue of an increased discount on the final price proposed to you, may contain conditions different from those set forth in these Terms and Conditions. Such conditions will be expressly indicated in the product sheet of the product on sale, will form an integral part of the contract and will prevail over these Terms and Conditions.

16.3. Cancellation due to the provider of the Services and/or the creator

16.3.1. In the event that Norwegian with Tor is forced to cancel the event for causes not attributable, directly and/or indirectly, to Norwegian with Tor, you will have the option to take advantage of another package of equivalent quality at no extra charge, or to be refunded, within 14 (fourteen) business days from the time of withdrawal or cancellation, of the amount of money already paid.

16.3.2. Norwegian with Tor may terminate the contract and offer the participant a full refund of payments already made for the offer, but is not obligated to pay additional compensation if:

(i) the number of persons registered for the event is less than the minimum provided for in the package and it notifies the participant of the termination of the contract no later than 7 (seven) days before the start of the event in the case of events lasting between 2 (two) and 6 (six) days or 48 (forty-eight) hours before the start of the event in the case of events lasting less than 2 (two) days; or

(ii) Norwegian with Tor is unable to perform the contract due to unavoidable and extraordinary circumstances and gives notice of termination of the contract and cancellation of the event prior to the commencement of the event.

17. Assignment of the contract to a third party

The Customer may not assign the contract to any third party.

18. Photography and Media Release

18.1. By accepting these Terms and Conditions, you grant Norwegian with Tor permission to take photographs or otherwise record images, portraits, or voices, and to publish them in any form, including, but not limited to, print, electronic, and video media.

18.2. You also consent and authorize Norwegian with Tor to use such images or depictions for any purpose, including, but not limited to, illustration, trade, advertising, or promotion. You understand and agree that Norwegian with Tor may publish such images or depictions without prior or subsequent notice. You also grant Norwegian with Tor permission to modify, crop, retouch, or otherwise alter such images or depictions and waives any right to inspect such images or depictions prior to publication.

18.3. You understand that Norwegian with Tor may use the images or depictions with or without associating its name with them and waives any privilege to approve any copy associated with such images or depictions prior to publication. You further waive any claim for compensation of any kind for the use or publication of the images or representations, and also waive any claim for damages of any kind, including, but not limited to, invasion of privacy or misappropriation, arising from the use or publication of such images or representations by Norwegian with Tor.

18.4. You have the right to request the removal of any photograph, video or recorded material in which you appear at any time by contacting Norwegian with Tor via email at [email protected] or on the “Contact Us” page of the Site.

19. Trademarks and intellectual property rights

All contents of the Site, such as but not limited to, text, graphics, trademarks, logos, icons, images, audio tracks, databases, software (and related source codes) as well as materials and documents that will be delivered by Norwegian with Tor to participants, including during the event, are protected by Legislative Decree No. 30 of February 10, 2005 (Industrial Property Code) and Law No. 633 of April 22, 1941 (Copyright Law), as well as by other applicable industrial and intellectual property laws. The aforementioned industrial and intellectual property rights in the contents of the Site are the exclusive property of Norwegian with Tor. Without Norwegian with Tor’s written consent, therefore, you may not, in any way, medium, or form, copy, modify, change, publish, publicly promote, distribute, use, sell, or transfer any materials, databases, or program strings on the Site, either in part or in whole.

20. Complaints and customer service

20.1. In order to assess your complaint, you are requested to provide Norwegian with Tor as soon as possible with all factual evidence to substantiate the complaint sending an e-mail to Norwegian with Tor at [email protected].

20.2. Prior to any booking, you are required to inquire about any local events such as, but not limited to, carnival, religious festivals, national holidays, holidays, fairs that could jeopardize the success of the event. No complaints may be made to Norwegian with Tor in this regard.

20.3. Norwegian with Tor undertakes to provide you, as soon as possible and in writing, with a receipt of the delivery of the communication and the handling of the complaint by the competent team. Expenses for the communication of disputes will be borne by you.

20.4. Complaints must be made individually (one for each reservation). No action will be taken on collective complaints. If the reservation has been made by an individual, including on behalf of and for other participants, each participant, individually, must file his/her own complaint.

21. Governing law and jurisdiction

21.1. These Terms and Conditions and the contractual relationship between you and Norwegian with Tor shall be governed in accordance with Dubai law and regulations. 

21.2. In the event of a dispute between Norwegian with Tor and you, the parties shall attempt to amicably resolve the dispute.

21.3. In the event of failure to reach an amicable solution to the dispute, the parties may attempt to reconcile the dispute before a Mediation Body, before taking the dispute to the competent judicial authority.

21.2. Any dispute inherent to, or arising out of, these Terms and Conditions and/or the contractual relationship between you and Norwegian with Tor and not settled as provided above, shall be devolved to the jurisdiction of the court where you have your residence or elective domicile.
